Rome, Jan. 31 (LaPresse) – The judges of the Court of Appeal did not validate, suspending the validation, the detentions of migrants who had arrived in the Cpr of Gjader in Albania last Tuesday, remitting the acts to the EU Court, pending the judgement on safe countries, scheduled for 25 February. Among the citizens brought to the Albanian centre are Egyptians and Sinhalese, who had been detained last Friday. A decision like those taken in previous validations. With the suspension of the judges' decision, once the validation deadline has expired, the migrants, mostly from Bangladesh and Egypt, will be returned to Italy. One of the devices, which LaPresse has seen, reads: ‘The judgment is to be suspended pending the decision of the Court of Justice. Since as a result of the suspension it is impossible to observe the term of forty-eight hours provided for validation, the detainee must necessarily be released, as the Constitutional Court has repeatedly affirmed in similar cases (in which a question of constitutional legitimacy was raised in the context of arrest validation proceedings). Article 14(4) of Legislative Decree no. 286 of 25 July 1998, in fact, links the loss of effectiveness of detention to the absence, for any reason whatsoever, of a validation order within the term of the detention.
