Rome, Jan 12 (LaPresse) – "Under Article 2 of the extradition treaty between the Government of the United States of America and the Government of the Italian Republic, extradition is permissible only for offenses punishable under the laws of both contracting parties, a condition that, based on the current records, cannot be considered met."
This is stated in the official note from the Ministry of Justice, announcing that Minister Carlo Nordio has submitted a request to the Court of Appeal of Milan to revoke the arrest of Iranian citizen Abedini Najafabadi Mohammad.
"The first charge against the Iranian citizen, 'conspiracy to violate the IEEPA,' does not correspond to any offenses defined and punishable under the Italian criminal code. As for the second and third charges, namely, 'conspiracy to provide material support to a terrorist organization resulting in death' and 'provision and attempted provision of material support to a foreign terrorist organization resulting in death,' no evidence has been presented to substantiate these accusations.
The only activity clearly identified involves, through companies linked to him, the production and trade with his home country of technological tools with potential, though not exclusive, military applications."
