Diciotti case, request to the CSM for protection measures for the Cassation judges

Rome, March 11 (LaPresse) – The CSM (Superior Council of the Judiciary) counselors have requested the opening of a practice to protect the judges of the United Sections of the Court of Cassation responsible for the ruling in the Diciotti case, which was followed last week by polemics and attacks from the majority.

Following the publication of the Court of Cassation's ruling, "comments were registered from several political figures aimed at delegitimizing the Court and harming the prestige and the nomophylactic function of the Court of Cassation," reads the document signed by the judicial councilors and three lay members.

The expressions used ("ideological rulings," "shameful ruling, improper interference," "frustrating decision") falsely and unacceptably suggest that the legitimacy function is subordinated to external interests to impose a particular political orientation on the Italian government.

For the reasons stated, it is requested to open, under Article 36 of the Internal Regulation, a practice to protect the independence and prestige of the Civil United Sections of the Court of Cassation.
