Milan, June 3 (LaPresse) – The Constitutional Court has declared admissible the appeal for a “conflict of attribution between branches of the State” raised by the Senate of the Republic against the Milan Prosecutor’s Office in the investigation for aggravated fraud against INPS over Covid furlough schemes, in which former minister Daniela Santanchè is the defendant. After the in-camera hearing on May 4, the panel of the Court, composed of judges Amoroso, Pitruzzella and Bernardini, accepted the appeal filed by the Senate regarding the alleged abuse of power through which Milan prosecutors and the Financial Police allegedly obtained audio recordings, chats and emails—non-intercepted but recorded by former employees of Santanchè’s Visibilia companies—in which the Fratelli d’Italia senator appears directly or as sender/recipient (including in copy) of communications, to be used in the investigation and trial. The Constitutional Court ordered that the ruling be notified to the Milan Prosecutor’s Office within 60 days. Pending the Constitutional Court’s decision, the criminal proceedings against Santanchè have been stalled for over a year at the preliminary hearing stage in Milan.
